Two New Zofran Lawsuits Filed in Texas and Massachusetts

There has been two new recent Zofran lawsuits filed in Texas and Massachusetts, both in Federal Court. The argument is that the makers of Zofran mislead them about the dangerous Zofran side effects in children when woman take Zofran for morning sickness. According to one of the Texas Zofran Lawsuit, the plaintiffs are suing for the following

  • strict products liability
  • negligence
  • fraud
  • breach of warranties
  • deceptive marketing practices

The Zofran lawsuits also mention that while Zofran was approved by the FDA to treat nausea in patients after radiation, it was never properly test by the FDA as a treatment for nausea in pregnant women. These particular Zofran lawsuits are against GlaxoSmithKline (GSK). There have been other lawsuits against GlaxoSmithKline and also Cook Select. There is currently pre stage activity in a Zofran MDL against Cook, but no Zofran MDL against GSK has been announced, only rumored. GSK previous paid over a billion dollars to resolve a civil charge by the Dept of Justice. The Texas Zofran lawsuit claims that Zofran caused a child to be born with a heart murmur and developmental problems due to the mother's Zofran use. The Massachusetts Zofran lawsuit claims a woman had to terminate her pregnancy due to fetal defects caused by Zofran. Many other Zofran lawsuits have been filed around the country including a woman who filed a Zofran lawsuit in Alabama.

In one of the Zofran lawsuits, it cites that GSK conducted test on animals with Zofran and they learned that Zofran can cross placental barrier and cause defects to offspring. Despite that knowledge GSK still actively marketed Zofran as an remedy for morning sickness in pregnant women. There have been over 200 adverse reports regarding Zofran side effects since 1992 about Zofran Birth Defects.
